Within the scope of these General Terms of Use (GTU), the following terms are defined as follows: 'Evo Poll' (also referred to as 'We', 'Our') refers to the company operating the userlab.com platform, including its employees and representatives. 'User' (also referred to as 'You', 'Your') refers to any legal adult individual using the platform after registration. 'Platform' refers to the userlab.com website and all its components. 'Content' encompasses all data and information available on the platform, including texts, images, videos, and comments.
1. Idoneità
Registration on Evo Poll is exclusively reserved for individuals who have reached the legal age of majority in their country of residence. By registering, you agree to provide truthful and up-to-date information and confirm that you have the legal capacity to enter into contracts in accordance with the laws of your country.
2. Utilizzo della piattaforma
Evo Poll provides a platform for testing and evaluating applications and websites. As a User, you agree to use the platform in compliance with other users and ethical rules: no defamatory, abusive, unlawful, or discriminatory behavior will be tolerated. Violation of these principles may result in sanctions up to and including permanent banishment.
3. Integrità dei test
The reliability of the tests relies on the authenticity and accuracy of the information you provide. Any plagiarism, falsification, or intentional manipulation of test results is strictly prohibited and may result in sanctions, including the cancellation of your rewards and banning from the platform in case of repeated violations.
4. Attività e ricompense
Tasks assigned on Evo Poll may vary based on the needs of the partners and ongoing campaigns. The nature and complexity of the tasks can influence the rewards awarded. Evo Poll reserves the right to modify the criteria for reward allocation without notice.
5. Partnership e concorsi
Evo Poll may collaborate with third-party entities to offer specific missions. Participation in these missions does not imply that Evo Poll endorses or approves the products or services of these entities. Contests organized on the platform are subject to specific rules, which will be communicated to the participants on a case-by-case basis.
6. Feedback e segnalazioni
The feedback and reports you submit significantly contribute to the improvement of the tested products and services. By submitting a report, you authorize Evo Poll to use, modify, and share your feedback for analysis and improvement purposes, while respecting your right to confidentiality.
7. Pagamenti
Rewards are awarded in euros and credited to your user account following the validation of your contributions. The payment of your earnings is automatically triggered as soon as your balance reaches the threshold of 100 euros. Below this threshold, earnings remain ineligible for withdrawal.
8. Eliminazione dell'account
You have the option to delete your user account at any time through your account settings. This action is irreversible and will result in the deletion of all your personal data and the loss of any unretrieved balance. In accordance with Article 7 of these GTU, if your balance has not reached the minimum threshold of 100 euros required for payment at the time of your account deletion, this balance will be permanently lost and cannot be subject to any claim or reimbursement.
9. Modifiche e interruzioni
Evo Poll reserves the right, at its sole discretion, to modify, suspend, or discontinue all or part of its services, including access to certain features or content, without notice and without incurring liability to users or third parties.
10. Limitazione di responsabilità
Within the limits permitted by the laws applicable in Dubai and Hong Kong, Evo Poll disclaims any liability for direct, indirect, incidental, special, consequential, or exemplary damages, including, but not limited to, loss of profits, goodwill, use, data, or other intangible losses, resulting from (i) your access to, use of, or inability to use or access the Platform; (ii) any conduct or content of third parties on the Platform; (iii) any content obtained from the Platform; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed its essential purpose.
11. Esclusione di responsabilità
As a User of the Evo Poll platform, you agree to defend, indemnify, and hold harmless Evo Poll, its officers, employees, contractors, agents, and suppliers against any claim, charge, cause of action, damage, loss, expense (including reasonable legal fees) arising from or related to your use of the platform, including but not limited to any breach by you of these Terms of Use, providing inaccurate, misleading or illegal content or information, or your failure to comply with applicable laws and regulations. This obligation to defend and indemnify will survive these Terms of Use and your use of the Evo Poll platform.
12. Legge applicabile e foro competente
These General Terms of Use are governed by and construed in accordance with the laws of Hong Kong without giving effect to any principles of conflicts of law. You irrevocably agree that the competent courts of the Hong Kong will have exclusive jurisdiction to hear and judge any dispute, claim, or controversy arising out of or related to these General Terms of Use and your use of the Evo Poll platform.
