General Terms of Use
Definitions
Within the scope of these General Terms of Use (GTU), the following terms are defined as follows: 'UserLab' (also referred to as 'We', 'Our') refers to the company operating the UserLab.com platform, including its employees and representatives. 'User' (also referred to as 'You', 'Your') refers to any adult individual using the platform after registration. 'Platform' refers to the UserLab.com website and all its components. 'Content' encompasses all data and information available on the platform, including texts, images, videos, and comments.
1. Eligibility
Registration on UserLab is exclusively reserved for individuals who have reached the legal age of majority in their country of residence. By registering, you agree to provide truthful and up-to-date information and confirm that you have the legal capacity to enter into contracts in accordance with the laws of your country.
2. Use of the Platform
UserLab provides a platform for testing and evaluating applications and websites. As a User, you agree to use the platform with respect for other users and in accordance with ethical rules: no defamatory, abusive, unlawful, or discriminatory behavior will be tolerated. Failure to comply with these principles may result in sanctions up to and including a permanent ban.
3. Integrity of Tests
The reliability of the tests relies on the authenticity and accuracy of the information you provide. Any plagiarism, falsification, or intentional manipulation of test results is strictly prohibited and may result in sanctions, including the cancellation of your rewards and a ban from the platform in case of repeated violations.
4. Tasks and Rewards
The tasks assigned on UserLab may vary depending on the needs of partners and ongoing campaigns. The nature and complexity of the tasks may influence the rewards awarded. UserLab reserves the right to modify the criteria for awarding rewards without notice.
5. Partnerships and Contests
UserLab may collaborate with third-party entities to offer specific missions. Participation in these missions does not mean that UserLab endorses or approves the products or services of these entities. Contests organized on the platform are subject to specific rules, which will be communicated to participants on a case-by-case basis.
6. Feedback and Reports
The feedback and reports you submit contribute significantly to the improvement of the products and services tested. By submitting a report, you authorize UserLab to use, modify, and share your feedback for analysis and improvement purposes, while respecting your right to confidentiality.
7. Payments
Rewards are awarded in euros and credited to your user account following the validation of your contributions. Payment of your earnings is automatically triggered as soon as your balance reaches the threshold of 100 euros. Below this threshold, earnings remain ineligible for withdrawal.
8. Account Deletion
You have the option to delete your user account at any time via your account settings. This action is irreversible and will result in the deletion of all your personal data as well as the loss of any unwithdrawn balance. In accordance with Article 7 of these GTU, if at the time of your account deletion your balance has not reached the minimum threshold of 100 euros required for a payment, this balance will be permanently lost and may not be subject to any claim or reimbursement.
9. Modifications and Interruptions
UserLab reserves the right, at its sole discretion, to modify, suspend, or discontinue all or part of its services, including access to certain features or content, without notice and without incurring any liability to users or third parties.
10. Limitation of Liability
To the extent permitted by the laws applicable in Hong Kong, UserLab disclaims any liability for direct, indirect, incidental, special, consequential, or exemplary damages, including, but not limited to, loss of profits, goodwill, use, data, or other intangible losses, resulting from (i) your access to, use of, or inability to use or access the Platform; (ii) any conduct or content of third parties on the Platform; (iii) any content obtained from the Platform; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been advised of the possibility of such damages, and even if a remedy set forth in these Terms of Use is found to have failed of its essential purpose.
11. Disclaimer of Liability
As a User of the UserLab platform, you agree to defend, indemnify, and hold harmless UserLab, its officers, employees, contractors, agents, and suppliers against any claim, charge, cause of action, damage, loss, or expense (including reasonable legal fees) arising out of or related to your use of the platform, including but not limited to any breach by you of these Terms of Use, the provision of inaccurate, misleading, or unlawful content or information, or your failure to comply with applicable laws and regulations. This obligation to defend and indemnify shall survive these Terms of Use and your use of the UserLab platform
12. Applicable Law and Jurisdiction
These General Terms of Use are governed by and construed in accordance with the laws of Hong Kong, without giving effect to any conflict-of-laws principles. You irrevocably agree that the competent courts of Hong Kong shall have exclusive jurisdiction to hear and judge any dispute, claim, or controversy arising out of or related to these General Terms of Use and your use of the UserLab platform.
